Congressman Krishnamoorthi Responds To Supreme Court Decision To Lift Injunction On Trump Administration’s “Public Charge” Rule

January 28, 2020

WASHINGTON, D.C. – Yesterday, the Supreme Court lifted a nationwide injunction blocking the Trump Administration's "public charge" rule, which would essentially create a wealth test for individuals looking to obtain a green card. As a result, the Trump Administration will now be permitted to reinterpret a provision of federal immigration law to deny immigrants green cards if they are expected to use government assistance programs, or become a "public charge."

"Since the first days of our nation's history, America has always been a nation of immigrants from all walks of life," said Congressman Raja Krishnamoorthi. "By creating an illegal and arbitrary wealth test in a backdoor effort to cut legal immigration to the United States, the Trump Administration has injected discrimination into our immigration system and is terrorizing immigrant communities. By giving the Administration the green light to enforce this immoral and illegal rule, the Supreme Court has circumvented the will of Congress and made a serious and troubling departure from long-standing judicial norms."

This development comes after the District Court for the Southern District of New York ordered an injunction against the Administration's rule in October. Yesterday's Supreme Court ruling stays this injunction, allowing the Administration to carry forward with its initial plans.
